These Terms of Service ("Terms") govern your access to and use of https://www.lumos-books.com (the "Site") operated by Lumos LLC ("Lumos," "we," "our," or "us"). By using the Site you agree to be bound by these Terms and to comply with all applicable laws and regulations. If you do not agree, please do not use the Site.

1. Eligibility

• Anyone may view the public pages of the Site.

Any reproduction, distribution, public display, or modification of the Content outside this license is prohibited without our prior written permission.
3. Trademarks – "Lumos," the book-stack logo, and related marks are unregistered trademarks (™) of Lumos LLC. Other trademarks appear for identification only and are the property of their respective owners.

4. Prohibited Conduct

You agree not to:

• Violate any law or regulation;
• Use any robot, spider, scraper, or other automated means to access or collect data from the Site;
• Introduce malware, attempt to gain unauthorized access, or interfere with the Site's operation;
• Impersonate any person or entity or misrepresent your affiliation with Lumos;
• Use the Site or its Content to develop, market, or operate a competing service.

We may suspend or terminate your access to the Site for any violation of these Terms, without notice.

5. Newsletter & Communications

By providing your e-mail address you consent to receive newsletters and occasional updates from us. You may unsubscribe at any time by clicking the "Unsubscribe" link in any message or by contacting info@lumos-books.com.

6. Third-Party Links

The Site may contain links to third-party websites (e.g., Amazon). We are not responsible for the content, privacy practices, or transactions on those sites. Access them at your own risk.

7. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, LUMOS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMOS LLC, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (i) FIFTY U.S. DOLLARS (US $50) OR (ii) THE AMOUNT YOU HAVE PAID TO US, IF ANY, DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain disclaimers or limitations; where they are disallowed, our liability shall be limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Lumos and its affiliates from and against any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your (a) use or misuse of the Site, (b) violation of these Terms, or (c) violation of any third-party rights.

10. Governing Law & Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law provisions. Any dispute arising out of or related to these Terms shall be resolved exclusivelyin the state or federal courts located in Boston, Massachusetts, and you consent to personal jurisdiction and venue in those courts.

11. Severability

If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lumos regarding the Site and supersede all prior or contemporaneous agreements, communications, and proposals, whether written or oral.
